Did Sean Hannity get his idea for "attorney-client privilege" from Breaking Bad?
In explaining his attorney-client relationship with Michael Cohen, Hannity said on his radio show Monday, “I might have handed him 10 bucks (and said,) ‘I definitely want your attorney-client privilege on this.' Something like that.” Breaking Bad fans were immediately drawing a comparison between Hannity and Bob Odenkirk's Saul Goodman, who told Walter White and Jesse Pinkman to “put a dollar in my pocket” to become their attorneys in a Season 2 episode. But as Kyle Swenson points out, citing a New Mexico Law Review article, that Breaking Bad scene and Hannity's comment are incorrect because there's no reason to exchange money to establish attorney-client privilege. “There is simply no reason to exchange a dollar,” according to the law review article by Armen Adzhemyan and Susan M. Marcella. “To invoke the privilege, Saul only needs to confirm that Walt and Jesse seek his legal advice as potential clients.”
